Once your subdivision has been consented to by Council, the next step is the land transfer survey. This survey in conjunction with the documentation submitted to Landonline by your solicitor, is what the new titles are referenced to. Land transfer surveyors are required by law to be carried out or supervised by a Licenced Cadastral Surveyor.
Licence Cadastral Surveyors are licenced under the Survey Act and hold Annual Practicing Certificates, issued by the Cadastral Surveyors Licensing Board. To train as a surveyor is no trivial undertaking - it requires a 4-year university degree and a period of several years practicing under the control of a Licenced Cadastral Surveyor along with sitting an extensive set of assignments and interview before the Cadastral Licencing Board. Your surveyor is therefore well trained to carry out your subdivision.
To undertake a land transfer survey, we search Landonline for the latest survey records and download the necessary data. We may carry out some office calculations to enable old survey marks to be located prior to undertaking the field survey work. During the field survey work, we mark the new boundary and connect to the necessary old survey marks to ensure that there are go gaps, overlaps or omissions in the boundaries created. The Surveyor Generals Rules 2010 lay down specific requirements for this field survey work that must be met. The next step is preparation of the survey plan in Landonline. Whilst Landonline is an electronic on-line land registry system, paper prints of the survey work can be generated. The survey plans and associated documentation are submitted to a QA process prior to obtaining Local Authority signatures and formal "lodging" with Landonline.
When the survey plans are "approved as to survey" and the associated legal documentation is in order, the survey will "deposit" and new titles will issue. This process takes approximately 10 days from when approval as to survey is obtained. These processing timeframes are considerably shorter than the previous manual system prior to Landonline.
The new titles are called "computer freehold registers" in Landonline so we should be talking of "CFRs" instead of "titles".
