Changes to Subdivision Rules indicated in the Draft Waipa District Plan

25ha Rule is now the 40ha Rule
- It appears that the previous Rule that allowed "simultaneous 25ha subdivisions and boundary relocation" will no longer exist. To shrink down a 40ha entitlement to a rural house site sized lot will no longer be as easy as under the old Rule. Applicants will have to go through the details of the Objectives and Policies and the effects based procedure, rather than dealing with a specific Rule that previously allowed this process. This type of subdivision will definitely be more difficult than the previous subdivisions using the 25ha Rule.
What is not clear is how Council proposes to handle the allocation of the previous 25ha entitlements detailed on consent notices but which are now effected by the 40ha entitlements. Is the current title area less the previous 25ha entitlements simply divided by 40 to give the current entitlement? The mechanism has not been spelled out in the District Plan.
